SKY1 TERMS OF SERVICE
Effective Date: February 10, 2026
PLEASE READ THESE TERMS CAREFULLY.
These Terms of Service (“Terms”) govern the purchase, access, and use of services provided by Sky 1 Technologies (“SKY1,” “we,” “our,” or “us”).
By purchasing, activating, or using any SKY1 service, you (“Customer” or “Client”) agree to be bound by these Terms.
If you do not agree, do not use our Services.
1. SERVICES
SKY1 provides managed web hosting, infrastructure services, DNS services, SMTP relay services (where provisioned), and related technical services (collectively, the “Services”).
Unless explicitly stated in a separate agreement:

Email inbox hosting is not included
-
Email marketing is not permitted
-
Root-level server access is not provided
-
FTP access is not provided
Each service tier may include specific limitations and configurations at SKY1’s discretion.
2. SKY1 CORE – MANAGED WEB HOSTING
Sky1 Core is a managed website hosting environment.
It includes:

Server-level management
-
Operating system maintenance
-
Security hardening
-
Standard monitoring
-
Controlled deployment environment
It does NOT include:
-
Email inbox hosting
-
Email marketing capability
-
FTP access
-
Root access
-
Custom server configuration outside SKY1’s standard stack
-
Emergency recovery of third-party systems unless separately contracted
-
Development services unless separately contracted
SKY1 retains administrative control over all managed hosting environments.
3. EMAIL & SMTP POLICY
3.1 No Email Marketing Allowed
Sky1-managed servers may NOT be used for:
-
Newsletter distribution
-
Promotional email campaigns
-
Cold outreach
-
Drip campaigns
-
Bulk list-based messaging
-
Marketing automation mail
-
Any mass-distribution email activity
Clients requiring marketing email must use an approved third-party platform or subscribe to a separate SKY1 email infrastructure service.
SKY1 reserves the right to immediately suspend outbound mail if marketing-related activity is detected.
3.2 Transactional Email
Transactional email (e.g., form notifications, order confirmations, password resets) may be permitted if:

Properly authenticated (SPF, DKIM, DMARC)
-
Within acceptable volume thresholds
-
Not reputation-threatening
SKY1 reserves the right to rate-limit, suspend, or reconfigure outbound mail to protect infrastructure integrity.
3.3 SMTP Relay
Where SMTP relay services are provisioned:

They are subject to usage thresholds
-
They may be monitored for compliance
-
They may be suspended to protect IP reputation
SMTP relay is not guaranteed and may require upgrade to a dedicated configuration.
4. BILLING & PAYMENT
Services are billed monthly unless otherwise specified.

First invoice is due upon activation.
-
Recurring invoices are billed monthly on the same calendar day.
-
Payment constitutes agreement to the current version of these Terms.
Failure to pay may result in suspension of any or all services.
SKY1 reserves the right to modify pricing at any time with reasonable notice.
5. AUTOMATIC RENEWAL
All services automatically renew on a monthly basis unless canceled prior to the renewal date.
Renewals occur at midnight PST.
It is the Customer’s responsibility to cancel prior to renewal to avoid charges.
6. CANCELLATION
Customers may cancel by submitting written notice through SKY1’s contact page.
Cancellation stops future billing but does not retroactively refund paid periods.
Accounts with outstanding balances may not be canceled until paid in full.
7. SUSPENSION FOR NON-PAYMENT
If any balance remains unpaid past due:
SKY1 may suspend or terminate any or all services associated with the account.
A grace period may be provided at SKY1’s discretion.
8. CHARGEBACKS
Disputed charges (chargebacks) may result in:

Immediate suspension
-
Permanent termination
-
$85 administrative fee per chargeback
All outstanding balances must be paid before service reinstatement.
9. BACKUPS & DATA RESPONSIBILITY
SKY1 may maintain backups where applicable. However:
-
Backup restoration is not guaranteed.
-
Backup retention periods may vary.
-
Clients remain ultimately responsible for maintaining their own data copies.
Extended recovery work may incur additional fees.
10. ACCEPTABLE USE
Customers may not:
-
Transmit spam
-
Host malware
-
Conduct phishing
-
Abuse system resources
-
Circumvent system controls
-
Deploy unauthorized software
-
Use Services for unlawful purposes
SKY1 may suspend services that threaten security or stability.
11. INFRASTRUCTURE CONTROL
SKY1 maintains full administrative control over all managed environments.
Clients may not:

Install unauthorized software
-
Modify server configurations
-
Demand root access
-
Bypass deployment controls
SKY1 reserves the right to standardize infrastructure for operational stability.
12. SERVICE MODIFICATIONS
SKY1 may modify:
-
Service plans
-
Features
-
Pricing
-
Infrastructure standards
Unsupported or outdated software may require upgrade or incur maintenance fees.
13. SERVICE AVAILABILITY
SKY1 strives for high availability but does not guarantee uninterrupted or error-free service.
Service credits, if any, are issued at SKY1’s discretion.
SKY1’s total liability for downtime shall not exceed the fees paid in the preceding 30 days.
14. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
SKY1 shall not be liable for indirect, incidental, special, or consequential damages.
Total liability shall not exceed the aggregate amount paid by Customer in the six (6) months preceding the claim.
15. INDEMNIFICATION
Customer agrees to defend and indemnify SKY1 from any claims arising from:

Customer content
-
Customer products or services
-
Copyright or trademark infringement
-
Misuse of Services
16. GOVERNING LAW
These Terms are governed by the laws of the State of California.
17. TERM REVISIONS
SKY1 may update these Terms at any time.
Continued use of Services constitutes acceptance of the revised Terms.
18. ENTIRE AGREEMENT
These Terms, along with the Acceptable Use Policy, Anti-Spam Policy, and Privacy Policy, constitute the entire agreement between SKY1 and Customer.
